ORDER

The petitioner, who was arrested and remanded to judicial custody on 22.09.2025 for the alleged offence punishable under Sections 103(1),

238, 309(6) & 311 of BNS, in Crime No.345 of 2025, on the file of the respondent police seeks bail.

2. The case of the prosecution is that, the petitioner herein is the paramour of A2 and due to money dispute between A1 and the deceased, the petitioner along with A1 committed murder of the deceased by assaulting him using cement slab; that thereafter robbed 3 sovereigns of gold jewels from the deceased and dumped the body in a drainage. Hence, the complaint was lodged and the petitioner was arrested.

3. Earlier, this Court dismissed the bail petition in Crl.OP.No.30424 of 2025 dated 07.11.2025 on the ground that the investigation is still pending.

4. Now, the learned counsel appearing for the petitioner submitted that the petitioner is a lady and she is in judicial custody since 22.09.2025. It is alleged that she conspired with A1, and that A2, pursuant to the said conspiracy, caused the death of the deceased and committed the offence of murder. Hence, he prayed to grant bail to the petitioner.

5. Learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that the

petitioner/A2 was in an illicit relationship with A1 and that both of them had gone to the house of the deceased to demand return of money and stayed there. It is alleged that, instead of repaying the amount, the deceased indulged in sexual intercourse with A2, which enraged the accused, and they are said to have attacked and murdered the deceased. He further submitted that the investigation is still pending. Hence, he opposed for the grant of bail to the petitioner.

5. This Court has perused the FIR and other connected records. It is seen that the petitioner had accompanied A1 and that both of them stayed together. After making the deceased consume liquor, and while the deceased was sleeping, they threw stone on his head and lifted him from his house, disposed of his body.

6. Considering the above facts that the petitioner had accompanied A1 and is alleged to have committed the offence while the deceased was sleeping and that the investigation is still pending, and since there is no change in circumstances, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 28.11.2025 drl
