Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorari, to call for the records of the 3rd respondent relating the impugned deed for appointing Power of Attorney, bearing Document No.944/2019 dated 20.02.2019 executed by 5th respondent to 7th respondent and the further impugned sale deed as Document No.1043/2019 dated 25.02.2019 executed by 7th respondent to 8th respondent for the land in extent of 3240 sq.ft. comprised in Survey No.671/2, Madura Madhanan Kuppam, Korattur Village, Ambattur Taluk, Thiruvallur District quash the same.

ORDER

The petitioner assails power of attorney dated 20.02.2019 bearing Document No.944 of 2019 and sale deed dated 25.02.2019 bearing Document No.1043 of 2019.

2. According to the petitioner, the power of attorney was executed by the fifth respondent in favour of the seventh respondent without any right, title or interest in the relevant property. Because the sale deed was executed on such basis by the seventh respondent in favour of the eighth respondent, it is stated that such sale deed is also illegal, null and void.

3. Learned Special Government Pleader accepts notice for respondents 1 to 4. He submits that such a challenge may be made only under limited circumstances.

4. The petitioner has approached this Court challenging documents that were registered in the year 2019. The affidavit in support of the writ petition does not contain any acceptable justification for the considerable 3/6

delay. Once the matter clearly involves disputed questions of fact, it cannot be conveniently addressed in summary proceedings under Article 226. The petitioner also has an alternative remedy by way of approaching the jurisdictional civil court.

5. For all these reasons, I am not inclined to exercise discretionary jurisdiction. This writ petition is dismissed without any order as to costs by leaving it open to the petitioner to approach the civil court.
