O R D E R

The petitioner herein apprehend arrest at the hands of the respondent police for the offences punishable under Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.164 of 2025, on the file of the respondent Police, seek anticipatory bail. 1/4

2. The allegation against the petitioner is that the petitioner was found in illegal transportation of 1 1⁄2 unit of jelly in a lorry. Hence, the complaint.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the investigation is at initial stage. He further submitted that the petitioner has no previous cases.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the gravity of the offence committed by the petitioner and the fact that the investigation is early stage, and if the anticipatory bail is granted, he would indulge in similar offence, this Court is not inclined to grant anticipatory bail to the petitioner.
