PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 3rd respondent not to register any sale deed, Agreement, Encumbrance or any other documents presented by the 4th and 5th respondents, related to the property of 3.98 acres in Ka.Sa.No.226 (SF.No.226 in the extent of 34 cents and 354 sq.ft.) situated in Kumarapalayam Village, Coimbatore Sub-Division - II, Coimbatore District by considering the petitioner's representation dated 08.11.2025 within a stipulated period of time fixed by this Hon'ble Court. ORDER
The petitioner seeks to restrain the third respondent from registering any conveyances or agreements relating to the property admeasuring about 3.98 acres in S.F.No.226 at Kumarapalayam Village, Coimbatore SubDivision - II. 2/5
2. Learned counsel for the petitioner submits that one P.Kavitha, who died subsequently, filed O.S.No.301 of 2008 before the V Additional District Judge, Coimbatore and that the petitioner has lodged an appeal in A.S.SR.No.97917 of 2019 against the judgment and decree dated 19.04.2017 in the said suit. He also submits that such appeal suit is likely to be listed at any time for admission. He also points out that an execution petition has been filed and that amendments have been made without notice to the petitioner.
3. Learned Special Government Pleader accepts notice for respondents 1 to 3. He points out that the civil suit was decreed in favour of the plaintiff on 19.04.2017 and that the appeal suit has not been numbered as on date.
4. As submitted by learned Special Government Pleader, the record shows that the judgment and decree was issued on 19.04.2017 and the appeal suit is still at the SR stage. In these circumstances, any order restraining the registration of instruments presented by the legal heirs of the 3/5
deceased plaintiff would be unjust. Therefore, I am not inclined to exercise discretionary jurisdiction in favour of the petitioner. The writ petition stands dismissed without any order as to costs. Consequently, the connected writ miscellaneous petition is closed.
