ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.09.2025 for the alleged offences punishable under Sections 296(b), 115(2), 118(1), 351(3) of BNS Act, 2023 @ 296(b), 115(2), 118(1), 351(3) of BNS Act, 2023 r/w Section 25(1)(a) of Arms Act, 1959, in Crime No. 585 of 2025 on the file of the respondent police, seeks bail.

The allegation against the petitioner is that on 26.09.2025 at around 7.30 pm the de-facto complainant along with his friends while returning to their home, the petitioner joined hands with other accused waylaid and attacked them with knife, caused injuries and threatened them. Based on the complaint, the petitioner was arrested on 27.09.2025.

The learned Counsel for the petitioner submits that in the FIR itself, A1 only attacked the de-facto complainant and others have not attacked him, further the petitioner is falsely implicated in this case, and the petitioner is ready to abide by any conditions imposed by this Court. He prays bail to the petitioner.

4.The learned Government Advocate [Criminal Side] appearing for the respondent police reiterated the prosecution case and submits that the petitioner is having 11 previous cases and two cases under Section 302 of IPC and four cases under Section 379 of BNS, 2023 and also he is a history sheeter. Therefore, he opposed for grant bail to the petitioner. 5.I have also gone through the FIR and other connected records which reveals that the petitioner has actively participated in this case and he is having eleven previous cases including two murder cases and four cases under Section 379 of BNS Act, and he is a history sheeter and one case is POCSO and other offences, this Court is not inclined to grant bail to the petitioner.
