ORDER
The petitioner, who was arrested and remanded to judicial custody on 15.11.2024, for the alleged offence punishable under Sections 126, 296(b), 115, 311, 324(4), 125, 351(3) of BNS, in Crime No.646 of 2024, on the file of the respondent police, seeks bail.
2. The allegation against the petitioner is that the petitioner joined hands with other accused involved in robbery of Rs. 8,200/- at knife point, hence a complaint was lodged and the petitioner was arrested.
3. It is further alleged that the petitioner was originally arrested and released on bail in this case and subsequently, he has not come forward to comply the condition, hence, on the basis of the petition filed before the Judicial Magistrate by the respondent police, the bail was cancelled on 17.07.2025 and he is in judicial custody from 22.07.2025.

Learned counsel appearing for the petitioner submitted that since the petitioner had previous cases and the condition imposed was to appear before the respondent police and due to the filing of false cases, he had not appear before the respondent police, which resulted in cancellation bail application. He 2/7
further submitted that he is in custody for nearly 100 days after cancellation. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner has 19 previous cases, including case of murder, and earlier, bail was granted and he has not obey the bail conditions. Once again, bail was cancelled and he was reminded to judicial custody. He further submitted that if the petitioner is granted bail, he will indulge in similar offences. Hence, he opposed for grant of bail to the petitioner.
6. Heard both sides and perused the materials available on record including the First Information Report.
7.Considering the fact that the petitioner was earlier granted bail and subsequently, bail was cancelled due to violation of bail conditions and now, he is in custody for nearly 100 days and the investigation is also concluded, I am inclined to grant bail to the petitioner, subject to certain conditions.
8. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, each for a like sum to the satisfaction of the learned X 3/7
Metropolitan Magistrate, Egmore, Chennai, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioner shall stay at Trichy and report before the learned Judicial Magistrate-I, daily at 10.30 a.m., for a period of four weeks;
[c] the petitioner shall not abscond either during investigation or trial;
[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be 4/7
registered under Section 269 B.N.S.
