Learned counsel for the petitioner submitted that pursuant to directions issued by this Court on 16.10.2025 in W.M.P. No.44108 of 2025 in W.P. No.39294 of 2025, the petitioner had taken steps to deposit 50% of the claim st respondent, but the same was refused by the 1 st respondent amount before the 1 seeking clarification with respect to the type of the account. Hence, he has filed this modification petition seeking appropriate directions from this Court with regard to the above.
2. Considering the submissions made by the learned counsel for the petitioner, para 3 of the order dated 16.10.2025 is modified as follows :-
3. In view of the same, this Court finds prima facie case in favour of the petitioner. Hence, there shall be an order of interim stay, on condition that the petitioner shall deposit 50% of the claim amount by way of Demand Draft, drawn in st respondent, within a period of two weeks from favour of the 1 the date of receipt of a copy of this order. On receipt of the st respondent Demand Draft for the aforesaid amount, the 1 shall deposit the same in an interest bearing Fixed Deposit for a period of one year and the same shall be renewed periodically till the disposal of this writ petition. Further, it is 2/4
made clear that failing such compliance within the stipulated time, the interim order granted by this Court will stand automatically vacated.
Accordingly, W.M.P. No.52044 of 2025 stands clarified with the above directions.
