ORDER

(The Order of the Court was made by P.Velmurugan, J) This Habeas Corpus Petition has been filed to direct the 1st and 2nd respondents, to produce the body of the petitioner's daughter namely Selvi.Devipriya, aged 19 years, before this Court and set her at liberty.

2. The petitioner is the mother of the detenu namely Devipriya. Based on the complaint lodged by the petitioner, a case in Crime No.700 of 2025 dated 09.11.2025, has been registered for 'Woman Missing'. When the matter came up before this Court on 01.12.2025, this Court, taking into consideration the fact that the detenue, aged 19 years, who left for college on 08.11.2025, did not return home, had directed the respondents/police to secure the detenu and produce before this Court on 08.12.2025.

3. Accordingly, on 08.12.2025, the respondents/police, secured the detenu and produced her before this Court and this Court, after hearing the statement of the detenu, sent the detenu along with her mother. Further, it was reported that the 3rd respondent, who was working as a Van Driver in the college of the detenu and who is a married man having two children, had illegally taken the custody of the detenu. Hence, this Court by orders dated 08.12.2025 and 11.12.2025, had directed the respondents/Police to secure the 3rd respondent and produce him before this Court. 2 / 4

4. In compliance of the earlier orders, today (18.12.2025), the respondents/Police, secured the 3rd respondent and produced him before this Court.

5. It is seen that the case in Crime No.700 of 2025 dated 09.11.2025 has been registered for 'Woman Missing'. The detenu was already secured and sent along with her mother. The 3rd respondent, who is alleged to have illegally detained the detenu, is a married man and having children.

6. Therefore, the 2nd respondent police is directed to alter the Sections of offences based on the statement of the victim/detenu and proceed further in accordance with law.
