This petition has been filed seeking to quash the case in Crime No.305 of 2017 pending on the file of the respondent police for the offences under Sections 279, 337 and 304(A) of IPC, 1860. 1/4
2. When the matter is taken up for hearing, learned Additional Public Prosecutor appearing for the respondent police submits that the investigation has been completed and the final report has been filed, further the de facto complainant has not been impleaded as a necessary party.
3. The learned counsel for the petitioner submits that there is a bar of limitation, since the final report has been filed belatedly.
4. In view of the above submissions, this Court is not inclined to quash the proceedings in crime No.305 of 2017, as the investigation has been completed and the charge sheet has been filed. However, it is made clear that it is open to the petitioner to challenge the final report in the manner known to law, after impleading the de facto complainant, if so advised.
5. Accordingly, this criminal original petition stands disposed of. Consequently, connected miscellaneous petition stands closed. 18.12.2025 rap 2/4
