ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.09115(2), 118(1), 351(3) @ into Section 109(1), 296(b), 115(2), 118(1), 351(3) of BNS, 2023 in Crime No.484 of 2025, seeks bail.

2. The allegation against the petitioner is that he is ranked as A1 in this case. It is alleged that the petitioner, along with the other accused, due to previous enmity, scolded the victim and, while consuming liquor, took him to a secluded place and attacked him with a knife, causing injuries. Hence, the complaint was lodged.

3. Learned counsel appearing for the petitioner submitted that the petitioner himself was attacked by the injured in this case and that the injured was the aggressor, therefore the occurrence took place for self protection. He further submitted that the injured was discharged from the hospital. Hence, he prayed to grant bail to the petitioner. 4.

Learned Government Advocate (Crl.Side) appearing for the

respondent reiterated the prosecution case and submitted that the petitioner was also joined the victim in consuming liquor, and during that time, three other persons attacked the victim with a knife due to previous enmity.He further submitted that the petitioner has seven previous cases pending against him. Hence, he opposed to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. This Court on perusal of the FIR and other connected records, it is seen that the petitioner along with two other persons had taken the victim to the lonely place and attacked him after consuming liquor and that the petitioner is involved in seven previous cases, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed.
