ORDER

The petitioner, who was arrested and remanded to judicial custody on 12.11.2024, for the offences punishable under Sections 8(c), 20(b)(ii)(C), 25 and 29(1) of Narcotic Drugs and Psychotropic Substances Act, (NDPS) 1985, in connection with Crime No.304 of 2024, on the file of the respondent Police, seeks bail.

2. The case of the prosecution is that on secret information, the car in which the petitioner and the co-accused were travelling was intercepted and they were found in possession of 40 kgs of ganja. Hence, the case. 3.

Now, it is the submission of the learned counsel for the petitioner that the petitioner is in incarceration for long period ie from 12.11.2024, however there is no progress in the trial and hence he seeks for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner also travelled in the car from which the commercial quantity is recovered and the petitioner has to satisfy the twin conditions as contemplated under NDPS Act. He further submitted that, final report filed 2/4

before 180 days and copies also furnished and now the case is posted for framing of charges and the trial is progressing.

This Court is of the view that, Section 37 of NDPS is applicable and it is also stated that the trial is progressing and the copies were also severed and now posted for framing of charges and if the petitioner is let out on bail at this stage, the trial would get stalled and hence, this Court is not inclined to grant bail to the petitioner.

Accordingly, this Criminal Original Petition stands dismissed. 02.02.2026 sma To 1.
