Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to consider petitioner's representation dated 05.11.2025 followed by representation dated 18.11.2025 in accordance with law pursuant to the assurance that petitioner undertakes to adjust the entire dues payable to the respondent bank within a period of 3 months. ORDER
(Order of the Court was made by the Hon'ble Chief Justice) This petition has been filed under Article 226 of the Constitution of India seeking indulgence of the Writ Court on the submission that the petitioner is willing to repay the entire loan liability and it only needs some breathing time.
2. Learned counsel for the respondents submits that the petitioner has been seeking indulgence of the bank since last two months, but has not repaid the loan amount.
3. We find that upon failure of the petitioner to repay the amount, the bank has proceeded to take necessary measures under Section 13(4) of the SARFAESI Act and pre-sale notice has been issued on 30.10.2025.
4. The petitioner's options are either to repay the amount or to approach the Debts Recovery Tribunal. No case is made out for interference by the Writ Court.
