ORDER

The writ petition has been filed seeking a direction to the 2 nd respondent to issue the Worksite Inspection and Plant and Machineries certificates to the petitioner relating to the Tender Notice No.38/2025-2026/HDO, dated 07/10/2025 by considering the petitioner's representation dated 19.11.2025.

2. It is the case of the petitioner that the petitioner is a Class-I contractor under the Highways Department. The first respondent has called for tender for the formation of Ring Road to Mannargudi Town connecting Thiruvarur - Mannargudi - Muthupet road (SH 202) with Thajavur - Mannargudi - Thiruthuraipoondi - Vedaranyam - Kodiyakkarai in Tender Notice No.38/20252026/HDO, dated 07/10/2025 from the eligible registered contractors. The tender required bidders to personally inspect the work site and obtain the Work Site Inspection certificate and the Working Condition of Plants & Machineries certificate from the concerned Divisional Engineer, which were mandatory pre

qualification documents. Applications for issuance of these certificate were to be submitted before the second respondent on or before 21.11.2025 at 17.45 Hours and after inspection, the Divisional Engineer shall issue Work Site Inspection certificate and the Working Condition of Plants & Machineries certificate before 26.11.2025.

It is the further case of the petitioner that the petitioner approached the nd respondent on 19.11.2025 requesting to issue work site inspection certificates and working condition of the plant and machineries certificates to the petitioner and the same has not been considered. Hence, the petitioner has filed the above said writ petition.

The learned counsel for the petitioner submitted that the 2 nd respondent being a public authority, who is duty-bound to process the request made by the petitioner within the prescribed time-lines. The last date for submitting the tender documents along with Work Site Inspection certificate and the Working Condition of Plants & Machineries certificate is 27.11.2025. Therefore, this Court may direct the 2 nd respondent to issue work site inspection certificate and working condition of the plants and machineries certificate to the petitioner by today itself.

5. The learned Special Government Pleader submitted that the representation of the petitioner dated 19.11.2025 has been closed and hence, a

direction be issued to the petitioner to file a fresh representation before the second respondent and thereafter, the certificates will be issued to the petitioner.

6. Heard the leaned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

Considering the fact and circumstances of the case and in view of the limited request sought for by the petitioner, this Court directs the petitioner to file a representation before the second respondent by today ie., 25.11.2025 and the second respondent thereafter, is required to issue work site inspection certificate and working condition of the plants and machineries certificates to the petitioner on 26.11.2025 before 5.00 P.M. The petitioner shall collect the same during office hours.

8. With the above directions, the writ petition is disposed. No costs. 25-11-2025 Tsg
