..Respondent(s) This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the entire records in pursuant to the impugned order in G.O.Ms.No.34 dated 28.02.2025 Handlooms, Handicrafts, textiles and Khadi (G1) Department issued by the 1st respondent and quash the same and consequently, direct the respondents No.1 to 3 to grant promotion to the petitioner as Assistant Director on par with the respondents No.4 to 9 who are his juniors and grant all other consequential attendant and monetary benefits to the petitioner. ORDER

This writ petition is filed by the petitioner to call for the entire records in pursuant to the impugned order in G.O.Ms.No.34 dated 28.02.2025 Handlooms, __________Page 2 of 6

Handicrafts, textiles and Khadi (G1) Department issued by the 1st respondent and quash the same and consequently, direct the respondents No.1 to 3 to grant promotion to the petitioner as Assistant Director on par with the respondents No.4 to 9 who are his juniors and grant all other consequential attendant and monetary benefits to the petitioner.

Learned counsel for the petitioner would submit that the petitioner was appointed as Junior Inspector, Sericulture by the second respondent in the year 1990 and thereafter, he was promoted as Assistant Inspector of Sericulture. This being the case, the respondents 4 to 9 were appointed as Assistant Inspectors of Sericulture by direct recruitment and they did not possess the qualification required for the said post, prescribed in G.O.Ms.No.1537, Industries Department, dated 29.11.1978 as mandated by G.O.Ms.No.173, dated 17.06.1986, issued by the Handlooms, Textiles & Khadi (G1) Department. Under this circumstances, the second respondent passed an order dated 24.10.2016, promoting the respondents 4 to 9 to the post of Inspector of Sericulture for the year 2016-17.

However, the petitioner was not considered for the said promotion, which led to inter-se-seniority dispute between the promoted and directly recruited Assistant Inspectors of Sericulture. Therefore, the petitioner has filed a writ petition in W.P.No.45177 of 2025, seeking promotion to the post of Inspector of Sericulture on par with the private respondents herein and this Court by its order dated 24.11.

writ petition. Against which, writ appeal was preferred before the Division bench of this Court. In the meanwhile, the first respondent issued G.O.Ms.No.34, dated 28.02.2025 Handlooms, Handicrafts, Textiles and Khadi (G1) Department, assigning the post of Deputy Director of Sericulture to the respondents 4 to 9 as full in charge (FAC). Challenging the said Government Order dated 28.02.2025, the petitioner has come forward with the present writ petition.

Per contra, learned Government Advocate appearing for the respondents would submit that the present impugned order in G.O.Ms.No.34, dated 28.02.2025, Handlooms, Handicrafts, Textiles and Khadi (G1) Department issued by the first respondent, in and by which, giving promotion to the private respondents to the post of Deputy Director is only a temporary incharge. Earlier, the petitioner filed a writ petition in W.P.No.4577 of 2025, seeking promotion to the post of Inspector of Sericulture on par with the private respondents herein, which was dismissed on 24.11.2025. Hence, the grievance sought by the petitioner is not sustainable one. Accordingly, he prays for dismissal of this writ petition.

5. Heard the learned counsel on either side and perused the materials available on record.

Though very many grounds have been raised by the learned counsel on either side, at the time of arguments, as rightly pointed out by the learned Government Advocate appearing for the respondents that the present impugned G.O., granting promotion to the private respondents to the post of Deputy Director is only a temporary incharge, and in no way affects the interest of the petitioners and therefore, this Court is not inclined to interfere with the same.

7. For the reasons aforesaid, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 09-12-2025 Index: Yes/No Speaking/Non-speaking order VM To:
