ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 326 BNS (431 IPC), 303(1) BNS (378 IPC) and Section 21(1) of Mines and Minerals (Development and Regulation) Act 1957 in Crime No.90 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that based on secret information, the respondent police conducted a search and found that some unidentified individuals were illegally extracting sand from the lake by using JCB machine and loading it onto a truck. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) appearing for the respondent police submitted that there is a specific overt act attributed to the petitioner and he was actively involved in the illegal activity. Hence, he opposed to grant of anticipatory bail to the petitioner.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the nature and gravity of the offence and the specific role attributed to the petitioner, and taking note of the serious impact such activities have on public resources and environment, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original petition is dismissed. 01.12.2025 kmm
