The petitioner seeks for a direction, directing the respondent to rectify the defect of date of birth in the passport and issue fresh passport to the petitioner. 1 / 4

2. The case of the petitioner is that the petitioner was born on 10.02.1970 and is uneducated. Her birth has not been registered with the authorities, however, her original date of birth has been mentioned in Aadhar Card, PAN Card, identity card issued by the Widow of Ex-Army Personnel reflecting 10.02.1970. Whereas, in the passport, it is reflecting as 11.07.1972 instead of 10.02.1970. The petitioner requested the respondents to rectify the mistake, however, the same has not been considered and in fact, the respondent has requrested the petitioner to produce the birth certificate, school certificate, transfer certificate, the petitioner has explained that since she is an uneducated, she is not able to produce such certificates. Hence, seeks for a direction.

3. The learned counsel for the respondent, on instructions, submitted that the petitioner has not produced certain documents as sought for by the respondent, since she has not produced the documents, the officials are not in a position to rectify the mistake crept in the passport.

5. It is the grievance of the petitioner that the petitioner is an uneducated and she has not studied in the school. Original date of birth has been reflected in Aadhar Card, PAN Card, identity card issued by the Widow of Ex-Army Personnel reflecting 10.02.1970, whereas, only in the passport, the date of birth has been wrongly reflected as 11.07.1972. To buttress her submissions, she has also relied upon the Aadhar Card, PAN Card, identity card issued by the Widow of Ex-Army Personnel. Considering the fact that the petitioner is an illiterate and not gone to the school instisting the petitioner to produce the school certificate is not proper and the same will not serve any purpose.

Such view of the matter, let the petitioner produce all the available documents to prove her date of birth, besides, she shall also obtain affidavits from her blood relatives, particularly, her living sister or brother and produce the affidavit supporting her date of birth before the authorities. On such production of the affidavit along with the documents available, the respondent shall consider and pass appropriate order within a period of one month from the date of receipt of a copy of this Order.
