PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, pleased to issue a Writ of Mandamus, directing the 2 nd respondent to initiate and conclude a fresh proceeding under Section 47-A(1) of the Indian Stamp Act, 1899 in respect of sale deed bearing no.6715/2022 in strict compliance with mandatory procedure within stipulated time that may be fixed by this Hon'ble Court.

ORDER
The petitioner had presented a document for registration and the same was registered as Document No.6715 of 2022 on the file of the third 2/7
respondent. Thereafter, it is stated that the petitioner received notice dated 30.06.2022 from the second respondent calling upon the petitioner to pay deficit stamp duty of Rs.4,34,000/-. The petitioner sent a representation in response thereto and requested that an enquiry be conducted. Since no action was taken thereafter, the present writ petition has been filed.
2. Learned Special Government Pleader accepts notice for all the respondents. He submits that an enquiry would be conducted under Section 47-A read with Rules framed thereunder after providing a reasonable opportunity to the petitioner. He also submits that proceedings would be initiated in this regard within two weeks from the date of receipt of a copy of this order.
3. By taking note of the submissions of learned Special Government Pleader, this writ petition is disposed of by directing the respondents to 3/7
conduct an enquiry in relation to the notice issued on 30.06.2022 by providing a reasonable opportunity to the petitioner. The entire process shall be concluded within three months from the date of receipt of a copy of this order. No costs. Consequently, the connected writ miscellaneous petition is closed.
