..Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus directing the 1st respondent to consider and pass orders on the petitioner's representation on 06.12.2024 and conducted a detailed enquiry against 8th respondent had made false statements claiming ownership of the said land.

ORDER

According to the petitioner, a fraudulent sale deed was executed by one Mrs.Suseela in the year 2010 and patta transfer order was issued on that basis. After submitting several representations seeking cancellation of the sale deed and for further action, the present writ petition has been filed.

2. Mr.U.Baranidharan, learned Special Government Pleader, accepts notice for respondents 1 to 6. Mr.S.Sugendran, learned Additional Public Prosecutor, accepts notice for the seventh respondent.

3. Learned Additional Public Prosecutor submits that the petitioner has withdrawn the complaint made to the Police.

4. From the affidavit, it appears that the petitioner is complaining about an allegedly fraudulent sale deed executed by one Suseela and the patta transfer obtained on such basis. If aggrieved by a fraudulent sale deed, the petitioner should take recourse to the jurisdictional civil court. If a patta transfer order was wrongly issued by the Tahsildhar concerned, an appellate remedy is provided before the Revenue Divisional Officer under the Tamil Nadu Patta Pass Book Act, 1983. The registering authorities do not have the power to cancel the sale deed. Therefore, the request for a mandamus cannot be entertained. Subject to the observations set out above, the writ petition is disposed of without any order as to costs.
