O R D E R

This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.11 of 2025, on the file of the first respondent Police.

Based on the complaint given by the second respondent/de facto complainant, who is the Branch Manager of Manapuram Finance Limited, Coimbatore, alleging that the accused had misappropriated the amounts collected from various borrowers, manipulated internal login credentials, forged documentation and caused loss to the company, the first respondent police registered a case in Crime No.11 of 2025, for the offences under Sections 406, 408, 417, 418, 420 and 471 of IPC on 03.05.2025, which is now sought to be quashed.

Learned counsel appearing for the petitioner submitted that the petitioner, who is arrayed as A3 in Crime No.11 of 2025, was working only as a staff member in Manapuram Finance Limited and that her employee code was misused by A1. He further submitted that the petitioner has no role in the aforesaid offence. Hence, he prayed to quash the First Information Report pending against the petitioner. 2/5

Per contra, the learned Government Advocate (Criminal Side) submitted that based on the complaint given by the second respondent/de facto complainant, the present case came to be registered on 03.05.2025. He further submitted that whether the petitioner's employee credentials were misused or not is a matter for investigation and only after the investigation, that whether the petitioner has any role in the case will come to light. He also submitted that the case is at a nascent stage of investigation and cannot be quashed at the initial stage. He reiterated that the investigation is at still at a preliminary stage and that the case requires a thorough investigation and therefore, this Court cannot interdict the same under Section 482 Cr.P.C. Hence, he objected for quashment of the case against the petitioner. 5.

Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and taking note of the fact that the case was registered only in the year 2025 and that the investigation is at a preliminary stage, this Court is not inclined to interfere with the investigation and does not find any merit in this petition to quash the First Information Report.

Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is closed. However, the 3/5

first respondent police is directed to conduct an investigation as to whether the employee code of the petitioner was misused and to file the final report as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order. 12.01.2026 ham To 1.
