The learned counsel for the appellants and the learned counsel for the respondent represented that the parties have entered into a memorandum of compromise. The appellant and the respondent, who are present before this Court today, also stated that they have gone through the terms of settlement and have signed the joint memorandum of compromise.

2. Since the matter has been settled between the parties, the present appeal stands dismissed as settled out of Court. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.

3. The joint memorandum of compromise and settlement filed on behalf of the appellants and the respondent shall form part this judgment. Since the matter is settled out of Court, the appellants are entitled for refund of the Court fees, as per the applicable Rules.
