ORDER

The Tamil Nadu State Road Transport Corporation (Kovai), Limited, 37, Mettupalayam Road, Coimbatore - 641043 is suo moto impleaded as second respondent to the writ petition.

2. I heard Mr.J.Franklin, learned counsel for the petitioner, Mr.G.Vinoth, learned counsel for Mr.N.Umapathi, learned Additional Government Pleader for the first respondent and Mr.Murali Vinoth, learned Standing Counsel for the second respondent.

3. The writ petitioner had purchased the property situated at door no.7 and 8 of N.H. Road, Coimbatore on 07.02.2024. He approached this Court by way of the present writ petition since the first respondent is constructing a bus stop right in front of his shop that he has purchased recently. According to him, the bus stand can be located 20 feet to the South of the proposed area. Taking into consideration the plea of the petitioner that the bus stand has been put up obstructing his property, I called upon Mr.Umapathy to get instructions whether the bus stop in the present location is essential and whether it will adversely affect the entrance of the writ petitioner. I also granted an order of status quo. 2/6

4. Mr.Umapathy pleaded that the bus stand has been in the said location for a very long time and that the old bus stand is being removed and a new bus stand is being constructed in its stead. He stated that the first respondent has written to the second respondent for instructions. He produced a copy of the letter dated 08.01.2026 to substantiate his plea.

5. Taking into consideration the plea of Mr.Umapathy, I called upon Mr.Murali Vinoth, learned Standing Counsel for the second respondent to get instructions from the second respondent as to whether it is a new bus stands or a pre existing one.

6. When I took up the matter today, Mr.Murali Vinoth has produced the following instructions, which scanned and extracted hereunder: 3/6

A perusal of the above instruction shows that the bus stop has been in existence for past 40 years and has been serving the public of Coimbatore, who board and de-board the bus at NH Road, Coimbatore. Since the bus stand is not a new one, but restoration of the existing one, I feel the petitioner does not have a case at all. The writ petition stands dismissed. No costs. 4/6
