O R D E R

This Writ Petition has been filed seeking a direction to respondents 1 to 6 to consider the petitioner's representation dated 30.09.2025 and to rectify and fix the petitioner's seniority in the Department of Physics, by declaring that the Petitioner as senior to the 7th respondent, Assistant Professor of Physics, and to make necessary entries in all relevant service and faculty records within the time frame to be stipulated by this Court.

2. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader takes notice on behalf of the 1st respondent. As no adverse order is being passed against respondents 2 to 7, notice to respondents 2 to 7 is dispensed with.

Brief facts that are necessary for disposal of Writ Petition are as follows:- The petitioner was appointed to the post of Assistant Professor of Physics in the 5th Respondent College on 01.02.2007 and was thereafter promoted as Associate Professor from 13.09.2020. It is the case of the petitioner that, despite possessing higher qualification, one K.Nagarajan who was appointed as Assistant Professor of Physics on the very same date but with lesser qualifications and eligibility has been placed senior to the petitioner which according to the petitioner is improper, particularly in view of the undisputed break in service suffered by said K.Nagarajan due to unauthorised absence followed by termination and subsequent reinstatement. Therefore, the petitioner submitted a representation dated 30.09.2025 to respondents 1 to 5 seeking re-fixation of his seniority in the Department of Physics. However, the said representation has not been considered till date. Hence, the present Writ Petition. 3/6

Learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the 1st respondent to consider the petitioner's representation dated 30.09.2025 and pass appropriate orders on the same on merits and in accordance with law within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned Additional Government Pleader appearing for the 1st respondent.

In view of the limited relief sought for by the petitioner, this Court without going into the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 30.09.2025 and pass appropriate orders on the same on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner and aggrieved persons if any, within a period of six (6) weeks from the date of receipt of a copy of this order.

7. Accordingly, this Writ Petition is disposed of with the aforesaid direction. No Costs.
