PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to implement the proceedings in Rc.No.333/F1/2023 dated 13.02.2023 and K.Dis.No.4293/D3/2023 dated 08.08.2023 passed by the 3rd respondent, re-fix my pay in the appropriate levels under the Career Advancement Scheme with effect from 17.06.2019 and 17.06.2022 respectively, by considering the my representation dated 18.08.2025 and to disburse all monetary benefits, including arrears of salary, allowances, retirement benefits and all other attendant benefits, together with interest at 12% per annum from 17.06.2019 till the date of actual disbursement, within a time frame to be fixed by this Hon'ble Court. O R D E R

This Writ Petition has been filed seeking a direction to the respondents to implement the proceedings dated 13.02.2023 and 08.08.2023 passed by the 3rd respondent and re-fix my pay in the appropriate levels under the Career Advancement Scheme with effect from 17.06.2019 and 17.06.2022 respectively, on the basis of her representation dated 18.08.2025 and to disburse all monetary benefits together with interest at 12% per annum from 17.06.2019 till the date of actual disbursement, within a time frame to be stipulated by this Court. 2/6

2. Mr.M.R.Gokul Krishnan, learned Additional Government Pleader takes notice on behalf of respondents 1 to 4.

It is the case of the petitioner that she is a retired Assistant Professor of the 4th respondent College and subsequently served on re-employment seeks enforcement of the duly sanctioned Career Advancement Scheme (CAS) placements granted by the 3rd respondent through proceedings dated 13.02.2023 and 08.08.2023, whereby she was upgraded from Level 11 to Level 12 and thereafter to Level 13A with corresponding monetary benefits. Despite the same, the petitioner having served till her retirement on 30.04.2025, the revised pay fixation was not implemented by the respondents and consequently, the arrears of salary, allowances and other such benefits were also not disbursed to the petitioner from 17.06.2019 onwards and therefore, in order to espouse the said cause, the petitioner made a representation dated 18.08.2025 to the respondents. However, the said representation has not been considered till date. Hence, the present Writ Petition.

4. Learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the respondents to consider the representation dated 18.08.2025 of the petitioner and pass appropriate orders on merits within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned Additional Government Pleader appearing for respondents 1 to 4.

In view of the limited relief sought for by the petitioner, this Court without going into the merits of the case, directs the respondents 3 & 4 to consider the petitioner's representation dated 18.08.2025 and pass appropriate orders on the same on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner and aggrieved persons if any, within a period of six (6) weeks from the date of receipt of a copy of this order.

7. Accordingly, this Writ Petition is disposed of with the aforesaid direction. No Costs.
