ORDER

The petitioner seeks for a direction, directing the respondents 1 to 3 to pay compensation based on the petitioner's representation dated 02.06.2025.

2. When the matter was taken up, there was no representation for the petitioner.

3. According to the petitioner, the petitioner's son had gone to the Velliyangiri Malai and by climbing the moutain and after coming down, his son had slipped, fell down and sustained grevious injury and succumbed to injury. Therefore, the petitioner seeks for a direction for compensation. 2 / 4

4. At the outset, this Court is of the view that the present writ petition is nothing but mere abuse of process of law. When the petitioner's son had died accidentally while getting down the hill, the question of compensation will not arise at all. Even assuming that there is any negligence to be attributed to the Government, the proper way is to file appropriate suit to establish the tortious liability, without doing so petition for mandamus simplicitor is not maintainable.

5. Accordingly, I do not find any merits in this writ petition and this writ petition stands dismissed. No costs.
