PRAYER Writ Petition is filed under Art.226 of Constitution of India seeking for issuance of Writ of Mandamus to issue a suitable direction directing the 2nd and 3rd respondents to conduct an enquiry on the objections submitted by the petitioner on 30.10.2025 in complaint No.2025-976-JRS For Petitioner(s):

Pleader for R3 to R5 Order This Writ Petition has been filed seeking a direction directing the 2nd and 3rd respondents to conduct an enquiry on the objections submitted by the petitioners on 30.10.2025 in Complaint No.2025-976-JRS.
2. According to the petitioners, the respondents 6 to 8 have recorded their names as legal heirs. The 1st petitioner is the legally wedded first wife and the 2nd petitioner is her daughter. But without including their names, the legal heir certificate and death certificate has been issued in favour of respondents 6 to 8. Hence, they have given their detailed objections on 30.10.2025, but no enquiry has been initiated by the authorities. Therefore, they seek a direction.
3. Heard Mr.M.Sriram, learned counsel appearing for the petitioner, Mrs.Ashwini Devi, learned Standing Counsel for the respondents 1 & 2 and __________Page 2 of 5
Mr.V.Jeevagiridharan, learned Addl. Government Pleader for respondents 3 to
5. Perused the materials available on record.
4. This Court is of the view that right of parties shall be adjudicated in a proper manner by filing a suit before the competent civil court. At any event, having limited prayer sought in the Writ Petition, the respondents 2 and 3 are directed to conduct enquiry on the objections given by the petitioners and pass orders on its own merit after giving opportunity to all the parties within a period of two weeks from the date of receipt of copy of this order.
5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Writ Miscellaneous Petition is closed.
