ORDER
This writ petition has been filed, seeking for a direction to the first respondent to pass final orders on the petitioner's representation dated 15.07.2025, seeking for cancellation of the respective pattas standing in the name of the respondent Nos.7 to 25 for the properties morefully described in the prayer to this writ petition within a time frame to be fixed by this Court.
2. The petitioner claims that he is the Muthavalli of the Wakf, viz., Chetpet Mosque @ Hajrath Batharsha Madina Dargah Sherif and Kabasthan Wakf. He claims that the private respondents have been illegally granted pattas in their names for the properties morefully described in the prayer to this writ petition. The petitioner seeks for cancellation of thosse pattas. The petitioner had submitted representation to the respondents on 15.07.2025, requesting them to cancel the respective pattas. Since the said representation has not been considered till date, he has filed this writ petition.
3. Mr D. Ravichander, learned Special Government Pleader accepts notice on behalf of R1, R2, R4 and R5 and Mr Abdul Mubeen, learned counsel accepts notice on behalf of R3 and R6.
4. No prejudice would be caused to the respondents if the petitioner's representation as stated supra is considered on merits and in accordance with law within a time frame to be fixed by this Court after hearing the objections of the respondents 7 to 25 as well as any third party whom the second respondent deems fit to enquire.
5. Since the earlier representation was given by the petitioner to the third respondent, a fresh representation will have to be given by the petitioner to the second respondent who is the competent authority for the very same relief.
6. Since no adverse orders are passed in this writ petition against the private respondents, notice to the respondents 7 to 25 in this writ petition are dispensed with.
7. This Court is not expressing any opinion on the merits of the petitioner's representation.
8. For the foregoing reasons, this Court directs the petitioner to submit a fresh representation to the second respondent seeking for cancellation of the respective pattas standing in the name of the respective private respondents for the properties morefully described in the prayer to this writ petition within a period of two weeks from the date of receipt of a copy of this order. On receipt of the said representation, within the stipulated time, the second respondent shall pass final orders on merits and in accordance with law on the said representation after issuing notice to the respective private respondents (respondents 7 to 25) or any other third party whom the second respondent deems fit to enquire and after hearing the objections of the petitioner as well as the private respondents and any other third party to whom the second respondent had issued notice and also after hearing objections of the subject Wakf within a period of six months thereafter.
9. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected writ miscellaneous petition is closed. 09-12-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes ab
