No.901 of 1995 in the office of the 2nd and 3rd respondents herein respectively, relating to the properties of the petitioner comprised in S.Nos.30 and 31 (New S.Nos.467 and 468), measuring a total extent of 8.48 acres situate at Pachchapalayam Village, Kangeyam Taluk, Tirupur District. ORDER
The petitioner has come forward with this writ petition seeking for a direction to the 1st respondent to issue discharge receipts towards the mortgage deed and Document No.1134 of 1993 on the file of Kangeyam Sub Registrar and the Document No.901 of 1995 on the file of Sub Registrar, Vellakoil.
2. When the matter came up for admission, Mr.Mohamed Sulaiman, learned counsel took notice for the 1st respondent and Mr.Stalin Abhimanyu, learned Additional Government Pleader took notice for the respondents 2 and 3. Mr.Mohamed Sulaiman sought time to produce the receipts. Accordingly,
yesterday he produced the receipt for the Document No.1134 of 1993. He had not produced the receipt for Document No.901 of 1995. Hence, the matter was posted for today.
3. When the matter was taken up, Mr.Mohamed Sulaiman has filed a typed set of papers enclosing the letters to the respondents 2 and 3 as well as the receipt dated 15.12.2025.
4. Mr.Sulaiman states that the petitioner has to approach the 1st respondent for receiving the original and thereafter has to to produce it before the respondents 2 and 3 for registering the same. He also states that the 1st respondent has informed the respondents 2 and 3 by way of letter dated 15.12.2025 that the presence of 1st respondent is not essential, as it is exempted under Section 88(1) of the Registration Act, 1908. The letter as well as the receipt are scanned and extracted hereunder:
4. Mr.Sulaiman states that the petitioner has to approach the 1st respondent for receiving the original and thereafter has to to produce it before the respondents 2 and 3 for registering the same. He also states that the 1st

5. The petitioner shall approach the 1st respondent and receive the original. On production of the same before the respondents 2 and 3, they shall register the same without insisting on the presence of the 1st respondent.
