O R D E R

The petitioners, who were arrested and remanded to judicial custody on 07.10.2025, for the alleged offence punishable under Sections 309(4) of BNS @ 310(2), 311 of BNS, in Crime No.691 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioners is that the petitioners joined hands with other accused followed the defacto complainant, attacked him and robbed a sum of Rs.10 lakhs and immediately, the defacto complainant lodged a complaint. Based on the complaint, the petitioners were arrested.

3. Learned counsel appearing for the petitioners submitted that the petitioners are falsely implicated in this case and that they have not committed any offence as alleged by the prosecution. He further submitted that the petitioners are ready to abide by any conditions that may be imposed by this Court. He further submitted that the petitioners are in judicial custody since 07.10.2025. Hence, he prayed for grant of bail to the petitioners.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that there are totally seven accused in this case and the petitioners are ranked as A6 and A7. He further submitted that petitioner/ A6 has 10 previous cases, whereas, the petitioner/A7 has two cases, similar in nature against them. He further submitted that out of Rs.10 lakhs, a sum of Rs.2.7 lakhs alone was recovered and that the investigation is pending. Hence, he opposed for the grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. Considering the submissions made by the learned counsel on both sides, the fact that the money robbed was not completely recovered and that the petitioners are having bad antecedents, this Court is not inclined to grant bail to the petitioners.
