The learned counsel for the petitioners would submit that the first petitioner is aged about 40 years and the second petitioner is aged about 65 years; that the proceedings before the Trial Court have been stayed by this Court in the quash petition filed by A3 in Crl.O.P.No.30188 of 2025, and therefore, the learned Magistrate ought to have accepted the petitions for recall of the warrants in the absence of the petitioners.
3. Heard the learned counsel for the respondents and perused the materials available on record.
4. It is seen from the impugned order that the petitioners were absent on 08.07.2025 and an NBW was issued on that day. They had filed a petition for recall of the warrant in their absence on 13.11.2025. The learned Magistrate had directed their personal appearance on 20.11.2025. It appears that this Court had granted stay of the proceedings in a quash petition filed by the co-accused by order dated 06.11.2025 in Crl.OP.No.30188 of 2025. However, considering that the warrants were issued on 08.07.2025 much before the interim order granting stay was passed by this Court, this Court is of the view that there is no infirmity in the impugned order directing the appearance of the petitioners for considering their recall warrant petition. Therefore, the petitioners may appear 3 / 5
in person before the learned Magistrate and seek recall of warrant, which may be favourably considered by the learned Magistrate.
5. With the above observations, these criminal revision cases stand disposed of. Consequently, connected miscellaneous petitions are closed. 12-02-2026 cda/ars 4 / 5
