ORDER

This writ petition is filed to direct the respondents to disburse the differential sum of Gratuity and Leave Encashment benefits to the petitioner based on Dearness Allowance revision with effect from 01.01.2024 with interest at the rate of 8% per annum from the said date of entitlement to till the date of actual disbursement.

2. By consent of both the parties, this writ petition is taken up for final hearing at the stage of admission itself.

3. The case of the petitioner is that the petitioner joined the service of the respondent corporation as Conductor on 24.08.1995 and retired on 31.03.2024 as Selection Grade Conductor. The dearness allowance granted for the transport employees were 46% of basic pay as on 01.07.2023. However, with effect from 01.01.2024, it was revised to 50% of basic pay. Under these circumstances, the petitioner's retirement benefits were disbursed with then prevailing rate of dearness allowance at the rate of 46% of his basic pay. Therefore, the petitioner has sent a representation dated 09.09.2025, seeking differential payment with interest at the rate of 8% per annum. However, the said representation was not Page No.2 of 5

considered, as on date. Hence, the petitioner has come forward with the present writ petition.

4. Though very many grounds have been raised in this writ petition, learned counsel for the petitioner submits that it would suffice, if this Court, issues a direction to the respondents to consider the petitioner's representation dated 09.09.2025, as expeditiously as possible.

5. Learned counsel appearing for the respondents submits that, the petitioner's representation dated 09.09.2025 will be considered and appropriate orders will be passed within a time frame that may be stipulated by this Court.

6. Heard the learned counsel on either side and perused the materials available on record.

7. Considering the limited relief sought by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the petitioner's representation dated 09.09.2025 with applicable interest and pass appropriate orders, on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
