ORDER

The petitioner, who was arrested and remanded to judicial custody on 07.05.2025 for the alleged offences under Sections 8(c), 20(b)(ii)(C), 28 and 29 of NDPS Act in R.R. No.16 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused transported 216 kgs of brownish green colour dry leaves and flowering tops believed to be Ganja concealed in a white colour Ashok Leyland vehicle bearing Registration No.AP16 TF 3401 on 05.05.2025. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent, she has not committed any offence as alleged by the prosecution and she has been falsely implicated in this case. He would further submit that the petitioner is under incarceration since 07.05.2025 and the earlier bail applications filed by the petitioner before this Hon'ble Court and before the learned Principal Sessions Judge, Special Court under EC & NDPS Act, Chennai were dismissed vide orders dated 04.11.2025 and 19.06.2025 respectively. There are change of circumstances. Charge sheet has also been filed. He further submits that the petitioner is ready and willing to abide by any condition that may be imposed by this Court and hence prayed for grant of bail to the petitioner.

The learned Special Public Prosecutor appearing for the respondent police strongly opposed to enlarge the petitioner on bail, the respondent police have recovered 216 kgs of Ganja from the petitioner and other accused and the same would come under the commercial quantity. Therefore, there is bar under Section 37(1)(2)(b) of NDPS Act.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. From the submissions made by the learned Special Public Prosecutor that commercial quantity of contraband has been seized from the petitioner, this Court could not find any reason to overcome the rigors under Section 37 of NDPS Act. In view of the same, it is not desirable to enlarge the petitioner on bail.

7. Accordingly, this Criminal Original Petition is dismissed. 12-03-2026 MJS Note:
