This petition has been filed under Section 528 BNSS, seeking to relax the condition that the petitioner shall report before the POCSO Court, Chennai at 10.30 a.m. on the 1st day of every English calendar month in Crl.M.P.No.3862 of 2024 in Crl.A.No.266 of 2024 dated 31.7.2024. For Petitioner(s):

ORDER

Vide order dated 31.07.2024 made in Crl.M.P.No.3862 of 2024 in

Crl.A.No.266 of 2024, this Court had suspended the substantive sentence of imprisonment imposed on the petitioner and enlarged her on bail on certain conditions and one among such conditions is that the petitioner shall appear before the trial Court on the 1st working day of every English calendar month at 10.30 a.m., pending Criminal Appeal. This criminal miscellaneous petition has been filed by the petitioner seeking relaxation of the aforesaid condition, on account of her serious indisposition.

2. Learned Government Advocate(Crl.Side) appearing for the respondent submitted that the petitioner has been complying with the conditions imposed by this Court without any default.

3. In view of the above, this Court is inclined to modify the condition imposed by this Court in respect of the appearance of the petitioner in the following manner.

Accordingly, the second condition insofar as the petitioner's appearance as imposed by this Court at para no.5 of the order dated 31.07.2024 made in Crl.M.P.No.3862 of 2024 in Crl.A.No.266 of 2024 alone stands modified to the effect that the petitioner shall appear before the trial Court once in four (4) months starting from the first working day of June 2026, until further orders. The first condition imposed in the order dated 31.07.2024 shall remain

unaltered.
