ORDER

The petitioner, who was arrested and remanded to judicial custody on 13.11.2025 for the offences punishable under Sections 7(1), 20(1) of Cigarette and Other Tobacco Products, Act, 2003 and Section 275 & 123 of BNS, 2023, in Crime No.457 of 2025, registered on the file of the respondent police, seeks bail.

2. The allegation against this petitioner is that, this petitioner was found in possession of 1.400 kgs of banned tobacco products. Hence this case.

3. The learned counsel appearing for the petitioner submitted that the petitioner have been falsely implicated in this case and the petitioner are in judicial custody since 13.11.2025; and that the petitioner are ready to abide by any stringent conditions that may be imposed by this Court and sought for bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that the petitioner was found in possession of 1.400 kgs of banned tobacco products and the petitioner 2/5

is not having any previous cases and opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case, that the petitioner was found in possession of 1.400 kgs of banned tobacco products and the petitioner arrested only recently, this Court is not inclined to grant bail to the petitioner at this stage.
