O R D E R

The petitioner, who was arrested and remanded to judicial custody on 19.09.2025, for the offence punishable under Sections 61(2) r/w.318(4), 336(2), 336(3), 336(4), 338 of BNS act, 2023 and section 66C and 66D of the IT Act in Crime No.22 of 2025, registered on the file of the respondent, seeks bail.

2. The allegation against the petitioner is that the petitioner is ranked as A1 in this case and he joined hands with other accused collected a sum of 1/5

Rs.19.95 crores from 70 victims under the pretext of online trading. Hence, the complaint.

3. The learned counsel for the petitioner submitted that, petitioner is also a victim in this case and his bank account was used by other accused and further no commission was also paid to him. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the investigation is pending. He further submitted that the main accused is operating in Delhi. He further submitted that the two accounts have been utilized for the purpose of scam, so far no money is recovered.

Considering the fact that the petitioner is in custody for 91 days and though Rs.21 lakhs was transferred to the petitioner's account but it was not used by the petitioner herein, and the money was taken away by some other accused, and immediately the petitioner also gave instructions to block his account to the concerned officials suspecting the transactions, I am inclined to grant bail to the petitioner with this Court is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate-I, Alandur, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;

[b] the petitioner shall report before the concerned Court daily at 10.30 a.m., for a period of three weeks and thereafter as and when required for interrogation. [c] the petitioner shall not abscond either during investigation or trial;

[d] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by 3/5

the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S. 18.12.2025 mpa Note:
