Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondents herein to prepare the panel as on 1.1.2022 and as on 1.1.2023 to the post of Middle 1/6
School Headmaster by strictly following the orders of this Court in W.P.No.17895 of 2022 dated 20.10.2022, and the order of the Hon'ble Division Bench in W.A.No.313 of 2022 dated 02.06.2023, as confirmed by the Hon'ble Supreme Court of India in Civil Appeal No.1389 of 2025 arising out of SLP No.37105 of 2023 dated 01.09.2025 by conducting promotion counselling from only among the eligible BT Assistants who possess TET Qualification by following an un-amended Rule in G.O.Ms.No.12 School Education (EE1(1)) Department dated 30.01.2020 as it stood prior to the Amendment vide G.O.Ms.No.243 School Education Department dated 21.12.2023 by taking into account that the amendment came into force only as on 31.12.2023. This writ petition has been filed for a direction directing the respondents herein to prepare the panel as on 1.1.2022 and as on 1.1.2023 to the post of Middle School Headmaster by strictly following the orders of this Court in W.P.No.17895 of 2022 dated 20.10.2022, and the order of 2/6
the Hon'ble Division Bench in W.A.No.313 of 2022 dated 02.06.2023, as confirmed by the Hon'ble Supreme Court of India in Civil Appeal No.1389 of 2025 arising out of SLP No.37105 of 2023 dated 01.09.2025 by conducting promotion counselling from only among the eligible BT Assistants who possess TET Qualification by following an un-amended Rule in G.O.Ms.No.12 School Education (EE1(1)) Department dated 30.01.2020 as it stood prior to the Amendment vide G.O.Ms.No.243 School Education Department dated 21.12.2023 by taking into account that the amendment came into force only as on 31.12.2023.

Without expressing any opinion on merits of the writ petition, the respondents are directed to prepare the panel as on 1.1.2022 and as on 1.1.2023 to the post of Middle School Headmaster by following the orders of this Court in W.P.No.17895 of 2022 dated 20.10.2022, and the order of the Hon'ble Division Bench in W.A.No.313 of 2022 dated 02.06.2023, as confirmed by the Hon'ble Supreme Court of India in Civil Appeal No.1389 of 2025 arising out of SLP No.37105 of 2023 dated 01.09.2025 by conducting promotion counselling from only among the eligible BT Assistants who possess TET Qualification by following an un-amended Rule in G.O.Ms.No.12 School Education (EE1(1)) 3/6
