O R D E R
The review had been filed by the petitioner seeking to review the order of this Court as there seems to have been a confusion with regard to the list of 1/4
voters, which had arisen. It is submitted by the learned counsel appearing for the petitioner that the respondents have claimed that the voters list would have to be only taken as on 31.05.2023, as recorded by this Court in paragraph No. 7 of its order.
2. This Court in paragraph No.7 of its order had recorded the statement that had been made by the respondents in their application to vacate the stay that had been granted by this Court. However, thereafter this Court had also recorded the statements made by the learned counsel appearing for the respective parties to request the learned Judge Commissioner to also decide the claim of respective parties in respect of finalising the voters' list.
3. Recording the said submissions, this Court to resolve the lis had also authorized the learned Judge Commissioner to hear the parties and take a decision and finalise the voters' list.
4. This Court vested the learned Judge Commissioner with the power to finalise the voters' list after hearing the respective parties.
5. It is clarified that what has been recorded by this Court in paragraph No.7 of the order is only the statement made by the respondents in the affidavit filed in support of the vacate stay petition and nothing else.
6. It is open to the learned Judge Commissioner to finalize the voters' list after hearing the respective parties and publish the voters' list. It is to be 2/4
noted that this order has been passed before 11 months back and still election has not been conducted for the aforesaid dispute. Hence, the learned Judge Commissioner is also requested to expedite the entire issue and take appropriate decision to finalize the voters' list.
7. In view of the same, there is no necessity to review the order made and accordingly, this review petition stands closed. Consequently, connected application No. 496 of 2026 is also closed.
