O R D E R

The petitioner, who apprehends arrest at the hands of the respondent police for the offence under Section 126(2), 115(2), 76, 351(2) of BNS r/w. Section 4 of TNPWH Act and Section 11(4), 12 of POCSO Act, 2012 in Crime No.227 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that he had stalked the victim girl, aged about 15 years, and coerced her to be a lover to him. When she refused and questioned his conduct, the petitioner allegedly threatened her with dire consequences and also threatened her to upload her photographs on the Internet. Hence, a complaint was lodged.

3. The learned counsel for the petitioner submitted that the petitioner is aged about 22 years, and that there is no such threat or intimidation as alleged by the defacto complainant. It is further submitted that the petitioner does not possess or has not uploaded any photographs and he has been falsely implicated in the present case. Hence he prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent State reiterated the prosecution case and, upon instructions, submitted that the petitioner, aged about 22 years, is a neighbour of the victim girl and had been continuously stalking her, attempting to take advantage of her age and seeking to commit favour. It was further submitted that the petitioner has one previous case registered under Section 506(2) of IPC. Hence, he opposed to grant anticipatory bail to the petitioner. 2/4

Considering that the petitioner has a previous case registered for an offence under Section 506(2) of IPC, and that he not only stalked the victim girl but also threatened her with dire consequences of uploading her photographs, and further taking into account the age of the victim girl, this Court is of the view that, if granted anticipatory bail, the petitioner is likely to indulge in similar activities. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed. 01.12.2025 ssi To:
