Aggrieved by the impugned order dated 04.11.2025 passed by the 2 nd respondent insofar as para 4 of the instructions therein, the present Writ Petition has been filed seeking to quash the same as also for a consequential direction to the Respondents herein to retain the sanctioned post of Junior Residents as available in the newly established 11 Government Colleges annexed herein and further under the strength of the Junior Residents.

It is the case of the petitioner that the members of the petitioner association were appointed as Junior Resident Assistants in the 11 Medical Colleges which were newly established in the year 2021. The number of posts filled in the cadre of junior resident assistants in all 11 colleges is 398. Whileso, the present impugned order dated 04.11.2025 has come to be passed by the 2 nd respondent, in which, Clause 4 of the instructions states that Junior Resident Assistants Posts under various categories sanctioned in 11 New Medical Colleges are to be surrendered and the concerned Medical Officers who are in occupation 3/8
of the Junior Resident posts are called upon to attend the Counselling compulsorily so as to opt for the available posts in their Specialties based on their seniority and that they will be given priority over other candidates of the concerned Specialties. Aggrieved by which, the petitioner has come up with the present Writ Petition.

Learned Special Government Pleader appearing for the respondents submitted that the members of the petitioner association were appointed as Junior Resident assistants in the 11 colleges in which colleges, the posts are going to be upgraded as Assistant Professor. It is further submitted that the total posts that are to be upgraded is 380 which would be evident from G.O.Ms.No.540 dated 27.11.2025. In such a situation, the transfer counseling is to be conducted, which will be in terms of the option exercised by the members of the petitioner Association. It is further submitted that no transfer would be effected in respect of the petitioners as against their choice and, therefore, any apprehension relating to removal from post or transfer expressed by the members of the petitioner Association is wholly misconceived.

In view of the submission made by the learned Special Government Pleader that the transfer of the members of petitioner's association would be as per their choice, the said submission is recorded and this Writ Petition stands closed. There shall be no order as to costs. Consequently, the connected Miscellaneous Petitions are closed.
