The petitioner, who was arrested and remanded to judicial custody on 27.10.2025, for the offence punishable under Sections 124-A, 417, 420 & 505 of IPC in Crime No.835 of 2012, registered on the file of the respondent, seeks bail.

The allegation against the petitioner is that, the petitioner was earlier arrested and released on bail in connection with Crime No. 835 of 2012 and thereafter case was investigated and final report was filed, however summons were not served and prosecution has taken steps to serve summons and on 08.07.2025, summons were returned with an endorsement that the petitioner refused to receive the summons and based on the endorsement, the learned Judicial Magistrate has issued NBW against the petitioner and accordingly, petitioner was arrested on 27.10.2025 and thereafter, on the very same day, petitioner was arrested and produced before the learned Judicial Magistrate and he started abusing the staffs including the Officer of the Court and the Judicial Magistrate and also used the filthy language. Hence, the complaint was lodged in Crime No.335 of 2025.

The learned counsel for the petitioner submitted that, petitioner has not refused to receive the summons and based on the false representation made by the respondent, NBW was issued and the petitioner was arrested on 27.10.2025. He further submitted that, petitioner is appearing before the Court as party in person and he is delicate in Court proceedings and he has never disrespected the Court or Officers of the Court. Hence, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that now the case is committed to Sessions and the same is pending. Hence, he prays for dismissal of the petition.

5. I have gone through the records and other connected materials. It revealed that the petitioner has abused the Officers of the Court including the Judicial Magistrate and though, it is stated that the petitioner is a law abiding citizen and he is appearing before the Court as party-in-person, his conduct is not condonable and it is a case of interference in administration of Justice. Hence, this Court is not inclined to grant bail to the petitioner.
