O R D E R

The petitioner, who was arrested and remanded to judicial custody on 03.05.2025, for the alleged offence punishable under Section 5(I), 6, 7, 8 of POCSO Act, 2012 in Crime No.13 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he is running a petty shop and was involved in committing penetrative sexual assault as well as sexual 1/4

assault on the victim girls who visited the shop. Hence, the complaint was lodged, and the petitioner was arrested and is in judicial custody.

3. Learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 03.05.2025 and he has been falsely implicated in this case. He further submitted that he is ready to abide any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that that there are totally five victims in this case. He further submitted that the petitioner, who is running a petty shop, used to molest the victims who visited the shop. He also produced copies of the statements of all the victims and submitted that the investigation has been completed, and the case has been posted for the examination of witnesses LWs. 24 to 28, out of 29 witnesses. However, he opposes to grant bail to the petitioner.

5. Heard both sides and perused the materials available on record including the First Information Report.

6. On perusal of the FIR and the statement of the victim girl, it is seen that various disturbing facts. Two of the victims have stated that the petitioner committed aggravated penetrative sexual assault, and three other victims have stated that the petitioner committed sexual assault. 2/4

7. Considering the above facts, the submissions made by the learned counsel on either side, and the fact that the trial has reached its final stage and is posted on 08.12.2025 for examination of LWs.26 to 28 out of 29 witnesses, this Court is not inclined to grant bail to the petitioner at this stage.
