ORDER

This writ petition has been filed, seeking for a direction to the third respondent to survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition and also for issuance of separate patta in favour of the petitioner pertaining to joint patta No.678 issued by the second respondent, based on the petitioner's application dated 02.03.2024, 16.09.2024, 07.01.2025, 01.09.2025 and 10.10.2025 within a time frame to be fixed by this Court.

2. The petitioner claims that he has acquired the property by virtue of a specific performance decree, which has been executed by the Executing Court through a sale deed in favour of the petitioner. The joint patta bearing No.678 for the property now stands in the name of the petitioner and two others.

3. The petitioner now seeks for issuance of separate patta for his portion of the property. He also seeks for survey and demarcation of boundaries.

4. No prejudice would be caused to the official respondents if the petitioner's online application referred to supra, seeking for survey and demarcation of boundaries as well as for issuance of separate patta in his name is considered on merits and in accordance with law after hearing the objections of the fourth respondent and any other third party whom the second respondent

deems fit to enquire.

5. This Court is not expressing any opinion on the merits of the petitioner's online application.

6. For the foregoing reasons, this writ petition is disposed of by directing the second respondent to pass final orders on the petitioner's online applications referred to in the affidavit filed in support of this writ petition, seeking for survey and demarcation of boundaries of the property morefully described in the prayer to this writ petition and consequently, issue separate patta in the name of the petitioner for his portion of the property (joint patta No.678) after hearing the objections of the fourth respondent and any other third party whom the second respondent deems fit to enquire within a period of four months from the date of receipt of a copy of this order.
