Writ Petition (Criminal) filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 1st respondent to appoint an enquiry officer to take appropriate action against 4th respondent, by consider the representation of the petitioner dated 20.11.2025 in accordance with law.

ORDER
This writ petition (criminal) has been filed seeking to direct the 1st respondent to consider the petitioner's representation dated 20.11.2025 and to consequently, appoint an enquiry officer for taking appropriate action against 4th respondent.
2. Mr.S.Santhosh, learned Government Advocate (Crl. Side) takes notice on behalf of the respondents 1 to 3. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal) is taken up for final disposal at the admission stage itself.
3. Since no adverse order is passed against the 4th respondent, notice to the 4th respondent is dispensed with.
4. Learned counsel for the petitioner submitted that the 4th respondent induced the petitioner to execute a lease agreement with him in respect of
the subject property which is an apartment situated at No.2, Block A, Ground Floor, Sonex Supriya Apartments, by making the petitioner believe that the said property belonged to him and he also received a sum of Rs.20,00,000/- from the petitioner towards lease amount. However, the petitioner was later evicted from the said apartment as per the eviction order of the court said to have been obtained by the alleged bank auction purchaser. He further submitted that, when the same was questioned by the petitioner, the 4th respondent gave evasive replies and failed to return the lease amount paid by the petitioner. Hence, on 08.03.2025, the petitioner lodged a complaint against the 4th respondent before the 3rd respondent.
However, the 3rd respondent, instead of registering a complaint, had unnecessarily prolonged the enquiry and failed to register the petitioner's complaint, based on the false undertaking given by the 4th respondent that he will return the money within six months. Therefore, the petitioner made a representation dated 20.11.2025 before the respondents 1 to 3 seeking to register his complaint dated 08.03.2025 and to consequently, appoint an enquiry officer for taking appropriate action against 4th respondent. However, till date, no action has been taken by the respondent police on the petitioner's representation. Accordingly, he prayed for appropriate orders.
5. Learned Government Advocate (Crl. Side) appearing for the respondents 1 to 3 fairly submitted that pursuant to the petitioner's representation dated 20.11.2025, an enquiry is being conducted in CSR.No.153 of 2025, on the petitioner's complaint and after completion of enquiry, appropriate orders will be passed on the said representation of the petitioner dated 20.11.2025 and if any cognizable offence is made out, the respondent Police will register a First Information Report and proceed in accordance with law.
6. In view of the above submission made by the learned Government Advocate (Crl. Side), this writ petition (criminal) stands disposed of and the 3rd respondent is directed to complete the enquiry in CSR.No.153 of 2025 within a period of four (4) weeks from the date of receipt of a copy of this order. No costs.
