The petitioner, who was arrested and remanded to judicial custody on 01.11.2025, for the offences punishable under Sections 294(b), 324, 506(ii) of IPC in C.C.No. 97 of 2024 registered on the file of respondent police, seeks bail.
2.The allegation against the petitioner is that earlier he was arrested and released on bail and subsequently, he appeared regularly before the Trial Court. On 30.10.2025, he has jumped bail, NBW issued and executed on 01.11.2025.
3.The learned Counsel for the petitioner submits that the petitioner was facing prolonged illness, therefore, he could not appear before the Trial Court on 29.10.2025 and the Trial Court has also issued NBW to the petitioner and he was arrested on 01.11.2025 and it is a case for the offence triable by the learned Magistrate and he is ready to co-operate for trial process.

4.The learned Government Advocate [Criminal Side] appearing for the respondent police while opposing the bail to the petitioner, reiterated the prosecution case and submits that the petitioner is having two other previous cases and the Trial Court is adjourned the case for examination of witnesses today.
5.Considering the nature of offence in this case, triable by the learned Magistrate and the period of incarceration of the petitioner from 01.11.2025, I am inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the learned 3/8
Judicial Magistrate, Paramathi, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] that the petitioner shall report before the learned Judicial Magistrate, Paramathi, daily at 10.30 am for a period of three weeks.
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the 3 rd petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can 4/8
be registered under Section 269 of B.N.S.
