ORDER
This writ petition has been filed seeking for a direction to the respondents to consider the petitioner's representation seeking for removing the name of the private respondents from the patta for the property, morefully described in the affidavit filed in support of this writ petition. 2.The following are the un-disputed facts:
a)The patta has already been issued for the subject property in favour of the private respondents in the year 2022 itself; b)Consequent to the issuance of patta in favour of the private respondents in the year 2022, the private respondents, who were issued patta for the subject property, have already executed a Sale Deed in favour of the 11th respondent in the year 2025.
3.In view of the un-disputed facts, referred to supra, the question of considering the petitioner's representation by the respondents does not arise. The only remedy available to the petitioner is to approach the Civil Court and seek cancellation of patta as well as the sale deed. Therefore, the relief sought for in the petitioner's representation dated 08.11.2025 cannot be granted by the respondents and even if the Court directs to consider the said representation, no useful purpose will be served as the respondents are only going to say that the petitioner will have to approach the Civil Court. 4.Learned counsel for the petitioner would now submit that liberty may be granted to the petitioner to approach the Civil Court for seeking the relief as prayed for in the petitioner's representation dated 08.11.2025, which is the subject matter of this writ petition.
5.For the foregoing reasons, this writ petition is disposed of by granting liberty to the petitioner to challenge the patta issued in favour of the private respondents as well as to challenge the sale deed issued in favour of the 11th respondent by approaching the Civil Court.
