C.M.P.No.10169 of 2026 in C.M.A (SR) No.69069 of 2023 C.M.P.No.10169 of 2026 in C.M.A (SR) No.69069 of 2023 C.V.KARTHIKEYAN, J., AND K.RAJASEKAR.J., (Order of the Cout was made by C.V.KARTHIKEYAN, J.,) This petition had been filed seeking to condone the delay of 136 days in filing the appeal against the award dated 27.01.2023 in M.C.O.P.No.1095 of 2015 passed by the Motor Accident Claims Tribunal, Perambalur.

2. Notice had been directed and counsel had entered appearance on behalf of first respondent /caveator.

3. It is contended by the respondent that after considerable delay, the award amount had been deposited by the petitioner/appellant. It is further contended that time should be granted for filing counter.

4. On a perusal of the reasons given for the delay, it is stated that the certified copy of the award got mixed up in the office of the Advocate and could be located only in the first week of October 2023 due to which the appeal could not be filed within the period of limitation.

5. Taking all factors into consideration, we would condone the delay. This petition is ordered as prayed for.
