ORDER

This Contempt Petition is filed seeking to punish the respondent for wilful disobedience of the order dated 04.04.2024 passed by this Court in Crl.R.C.No. 638 of 2024.

This Court by its order dated 04.04.2024, permits the revision petitioner to make a complaint before the Superintendent of Police, Mettupalayam Police Station, Pondicherry, in person along with the copy of that order within a period of two weeks and on receipt of the said complaint, the Superintendent of Police concerned is directed to consider the same by strictly adhering to the provision prescribed under Section 154(3) of Cr.P.C., and pass appropriate orders within a period of four weeks thereafter. However, the said order was not complied with thereby, the present contempt petition is filed. 3.

The learned Public Prosecutor (Pondy) appearing for the respondent would submit that the petitioner filed a complaint under Section 154(3) of Cr.P.C., before the learned Judicial Magistrate No.VI, (FAC), Puducherry, in Crl.M.P.No.5810 of 2023 and the same was dismissed. Challenging the same, the petitioner filed a Revision Petition before this Court in Crl.R.C.No.638 of 2024 and this Court by its order dated 04.04.2024, permitted the petitioner to file a complaint within a period of two weeks before Page No.2 of 4

the respondent Police. Pursuant to which, on the complaint made by the petitioner, the respondent police conducted enquiry and arrived at a conclusion that there is a civil dispute between the parties and deferred the case. 4.

In view of the above, no willful disobedience on the part of the respondent and the Contempt Petition stands closed. Liberty is granted to the petitioner to file a private complaint under Section 200 of Cr.P.C., or a petition before the Civil Court for appropriate relief. 23-01-2026 Index : Yes/No Speaking/Non-speaking order : Yes/No rts To
