..Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the Respondent to register the decree in O.S.No.137 of 2023 dated 28/07/2025 on the file of the Subordinate Court, Vaniyambadi, Thirupattur, passed in favour of the petitioner.

ORDER

After obtaining a decree in O.S.No.137 of 2023 from the Subordinate Court, Vaniyambadi on 28.07.2025, the petitioner presented the same for registration. By asserting that the registering officer orally refused to register the decree, the present writ petition has been filed.

2. Ms.Akila Rajendran, learned Government Advocate, accepts notice for the sole respondent. On the basis of written instructions, she submits that the relevant survey numbers are classified in the revenue records as Government land.

3. There is no indication from the materials on record that the decree in O.S.No.137 of 2023 has been reversed by an appellate Court. In those circumstances, the registering officer cannot decline registration on the ground that the land is classified as Government land in the revenue records or for any other reason.

4. Therefore, this writ petition is disposed of by permitting the petitioner to re-present the decree for registration within two weeks from the date of receipt of a copy of this order. Subject to remittance of requisite stamp duty and registration fees, the registering officer shall complete the registration process within two weeks from the date of re-presentation. There will be no order as to costs.
