2. Tr.C.M.P. No.1324 of 2025 has been filed by husband and others seeking withdrawal and transfer of D.V.C.No.11 of 2025 from the file of the learned Judicial Magistrate Court, Palladam, to the file of the learned Judicial Magistrate Court, Coimbatore.

3. Tr.C.M.P. No.1325 of 2025 has been filed by husband seeking withdrawal and transfer of H.M.O.P. No.84 of 2025 from the file of the learned Judicial Subordinate Judge, Palladam, to the file of the Family Court, Coimbatore.

4. The petitioner (husband) and the respondent (wife) were married on 19.05.2010 and they have two minor daughters. It is stated that the petitioner is residing at Coimbatore and is taking care of the children, and that the respondent is employed in Saudi Arabia.

It is the case of the petitioner that the respondent have initiated multiple proceedings arising out of the matrimonial dispute, namely D.V.C.No.11 of 2025 before the Judicial Magistrate Court, Palladam and H.M.O.P.No.84 of 2025 before the Sub Court, Palladam. The petitioner/husband in Tr.CMP.No.1325 of 2025 states that Palladam Court is about 50 kms away from his residence and that he has to drop and pick up the children from school and hence attending the Courts at Palladam on different

hearing dates causes serious hardship. It is also stated by the petitioner/husband that the respondent, being employed abroad, would in any event have to travel to India for effective hearings; therefore, transfer to Coimbatore would not cause hardship to her.

6. This Court has considered the pleadings and the reasons assigned. In the present case, the petitioner/husband pleads custody and day-to-day responsibility of the two minor daughters, the necessity to attend two proceedings at Palladam on different dates, and the difficulty in travelling from Coimbatore to Palladam. The respondent is stated to be working abroad. Considering the overall circumstances, this Court is of the view that withdrawal and transfer of both proceedings to Coimbatore would subserve the ends of justice and also facilitate orderly adjudication. Accordingly, the Transfer Civil Miscellaneous Petitions are allowed, with consequential directions.

7. Accordingly, Tr.C.M.P.No.1324 of 2025 is allowed.

D.V.C. No.11 of 2025 on the file of the Judicial Magistrate Court, Palladam, is withdrawn and transferred to the file of the Judicial Magistrate Court, Coimbatore. The Judicial Magistrate Court, Palladam, shall transmit the entire records to the Judicial Magistrate Court, Coimbatore, within three (3) weeks from the date of receipt of this order and the Judicial Magistrate Court, Coimbatore shall dispose of the matter in accordance with law, as expeditiously

as possible, uninfluenced by any observations made in this order and the connected C.M.P. No.30302 of 2025 is closed. There shall be no order as to costs.

8. Accordingly, Tr.C.M.P. No.1325 of 2025 is allowed.

H.M.O.P. No.84 of 2025 on the file of the learned Judicial Subordinate Judge, Palladam, is withdrawn and transferred to the file of the Family Court, Coimbatore. The learned Judicial Subordinate Judge, Palladam, shall transmit the entire records to the Family Court, Coimbatore, within three (3) weeks from the date of receipt of this order and the Family Court, Coimbatore shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order and the connected C.M.P.
