ORDER
The Writ Petition is filed for a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 06.01.2025 and further direct the respondent to settle all the monetary benefits including arrears of back wages in the regular scale of pay as per the directions given in the award passed by Labour Court, Chennai on 21.05.2015 in I.D.No.367 of 2007.
2. Mr.P.Srinivas, learned Standing Counsel takes notice for the respondent. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself.
3. The petitioner's mother, K.Valarmathi (deceased) was appointed as conservancy staff on 12.11.1998 in Old Pallavaram Municipality. While she was in service, on 13.05.2003, she fainted due to jaundice and was hospitalized. The petitioner's mother therefore went on medical leave and thereafter, on recovery reported for work on 24.11.2003. However, the officials prevented her from reporting for duty. On 21.11.2005, the Pallavaram Municipality issued notice of enquiry to the petitioner's mother on 26.11.2005, and thereafter, dismissed her from service. The petitioner's 2/6
mother raised a dispute in I.D.No.367 of 2007, before the Second Additional Labour Court, Chennai against the dismissal order and prayed for reinstatement with continuity of service and back wages. The Labour Court on 21.05.2015, passed an award directing the Pallavaram Municipality to reinstate the petitioner's mother and to pay the back wageson the basis of consolidated pay of Rs.1,200/- per month from 24.11.2003, to the date of reinstatement in service. The said order was challenged by the Pallavaram Municipality in Writ Petition in WP.No.36516 of 2015. This Court by order dated 11.07.2024 dismissed the Writ Petition.
4. The petitioner states that after the dismissal of the Writ Petition, no action was taken by the respondent to regularise the service of his mother and in the meantime, she died on 19.10.2024. The petitioner states that since the Pallavarm Municipality, was merged with the Tambaram Corporation, the petitioner submitted a representation on 06.01.2025, seeking the benefits arising out of regularisation of his mother's service, by annexing documents, namely, death certificate, legal heir certificate, etc. Since no action was taken on the petitioner's representation, the petitioner was constrained to file the above Writ Petition for the aforesaid relief. 3/6
5. The learned counsel for the petitioner submits that though the petitioner has sought for larger relief in the Writ Petition, it would suffice if a direction is issued to the respondent to dispose of his representation within a time frame fixed by this Court.

In view of the facts and circumstances of the case and considering that the petitioner's representation is pending with the respondent since 06.01.2025, i.e., for the past 10 months, this Court is inclined to direct the respondent to consider the representation of the petitioner dated 06.01.2025 on merits and in accordance with law and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order.
