ORDER
The petitioner, who was arrested and remanded to judicial custody on 05.03.2025, for the alleged offence punishable under Sections 397, 394, 392 r/w34 of IPC in connection with S.C. No.228 of 2025 on the file of the learned XX Additional City Civil Judge, Chennai, in Crime No.772 of 2019, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner was involved for the offence under Sections 397, 394, 392 r/w34 of IPC . Earlier, he was arrested and released on bail. Due to health issue, the petitioner did not appear before the concerned trial Court and hence Non-Bailable Warrant (NBW) was issued against him on 25.07.2023 and the same was executed on 05.03.2025.
3. Learned counsel appearing for the petitioner submitted that the petitioner was earlier arrested and released on bail. Due to illness, he could not appear before the Trial Court, pursuant to which, NBW was issued against him. He further submitted that the petitioner is in judicial custody since 05.03.2025. Hence, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner failed to appear before the concerned Court on 28.07.2023, pursuant to which a NBW was issued against him. He further submitted that the petitioner is having three previous cases similar in nature, pending against him and that the case is now posted for examination of Investigating Officer. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record including the First Information Report.
6. Considering the fact that the petitioner was already granted bail and, 2/4
thereafter, due to his non-appearance before the Trial Court, a Non-Bailable Warrant was issued and executed, that the case has now reached the stage of completion of the examination of the Investigating Officer, and that the petitioner has bad antecedents, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, the Criminal Original Petition is dismissed. 04.12.2025 drl To
